Legislator-Zusammenfassung

KI-generiert

The Federal Constitutional Court dismissed the applicant’s motion for reinstatement, leaving the time-barred constitutional complaint inadmissible, as the motion itself failed to meet procedural requirements. The dispute concerned the applicant's failure to comply with the statutory deadline for filing a constitutional complaint, for which he subsequently sought relief from the consequences of delay. Under § 93 (1) and (2) sentence 2 of the Federal Constitutional Court Act, reinstatement requires the applicant to demonstrate both an absence of fault regarding the original missed deadline and the filing of the motion within two weeks of the removal of the impediment; the Court held that the applicant neither sufficiently substantiated a lack of fault nor filed the reinstatement request within the mandatory two-week window, rendering the application procedurally defective and unreviewable.
