Legislator-Zusammenfassung

KI-generiert

The Federal Constitutional Court dismissed the connected constitutional complaint proceedings as moot due to their extinction in the main subject matter, ruling in favor of the complainants by ordering the respondent state to reimburse their necessary legal expenses under § 34a Abs. 3 BVerfGG and fixing the value in dispute for both the main complaint and the interim relief procedures at a total of €10,000. The case involved a procedural motion regarding the final disposition of multiple joined constitutional complaints following a de facto resolution of the underlying dispute, necessitating a formal settlement of costs and procedural fees. The decision rests on the specific statutory provisions governing expense reimbursement in constitutional proceedings and the court's authority to determine the subject matter value for attorney fee calculations.
