Legislator-Zusammenfassung

The Federal Constitutional Court issued a non-acceptance decision, ruling that the applicant's constitutional complaint was inadmissible, leaving the underlying lower court decisions in force. The dispute concerned a family law matter where the applicant challenged the substantive content of regional court rulings via a constitutional complaint but had previously failed to submit a statement or raise specific objections against a notice served pursuant to § 522(2) sentence 2 of the Code of Civil Procedure. The Court held that the complaint violated the constitutional requirement of subsidiarity (exhaustion of legal remedies), as the applicant had not taken all reasonable steps to assert her rights before the specialized courts, thereby precluding the Court from examining the alleged substantive constitutional defects in the lower courts' reasoning.

Cited in the first order to establish that the complainant failed to exhaust remedies by not submitting a statement to the lower court's notice, rendering the constitutional complaint inadmissible due to lack of subsidiarity.

§ 93d Abs. 1 S. 3 BVerfGG

Cited in the second order as the procedural basis for omitting a further substantive justification for the non-acceptance decision.

Nichtannahmebeschluss: Subsidiarität der Verfassungsbeschwerde bei Unterlassen einer Stellungnahme gem § 522 Abs 2 S 2 ZPO

[GRUENDE]
