Sufficiency of predictive elements in assembly ban: hostile state views and left-autonomous participation as standalone justifications for violence prognosis
Legislator-Zusammenfassung
KI-generiertThe Federal Constitutional Court issued a non-admission decision, leaving the challenged assembly ban in force and finding the complainant's complaint inadmissible, while noting that the underlying safety prognosis was not fully constitutionally sustainable. The dispute concerned a prohibition order for a public assembly, where the applicant challenged the lower court's assessment that hostile attitudes toward the state and police, combined with the anticipated participation of a significant number of individuals from the left-wing autonomous scene, constituted sufficient grounds to predict violent conduct. While the Court held that these specific factors alone did not form a robust basis for a violence prognosis, it concluded that considering the totality of the circumstances, the lower court's evaluation remained within its margin of discretion, resulting in no remedy granted.
