Legislator-Zusammenfassung

KI-generiert

The Federal Constitutional Court dismissed the applicant's request for legal aid and the appointment of a lawyer, leaving the order unchallengeable. The dispute concerned a constitutional complaint against the initial rejection of legal aid, where the applicant sought representation in the constitutional proceedings. The Court held that the intended constitutional litigation lacked sufficient prospects of success under § 114 Abs. 1 Satz 1 ZPO because the applicant failed to satisfy the principle of subsidiarity, a mandatory precondition for admissible constitutional complaints.
