Excusability of missed constitutional complaint deadline due to legal error on service requirements under § 93 BVerfGG
Legislator-Zusammenfassung
KI-generiertThe Federal Constitutional Court declined to reopen the previous procedural state and refused to admit the constitutional complaint, thereby upholding the initial inadmissibility finding against the complainant. The dispute concerned a missed one-month filing deadline for a constitutional complaint under § 93 of the Federal Constitutional Court Act (BVerfGG); the complainant argued that his failure to meet the deadline was excusable because he mistakenly believed the period only began after formal service of the decision and a legal remedy instruction. The Court held that a mere legal error regarding the calculation of procedural deadlines does not constitute "fault" sufficient to warrant reinstatement under German procedural law, as such misinterpretation does not exempt a party from the strict time limits imposed by statute.
