Denial of reinstatement of missed filing deadline based on lack of diligence in identifying constitutional complaint formality requirements.
Legislator-Zusammenfassung
KI-generiertThe Federal Constitutional Court rejected the petitioner's application for reinstatement into the previous state and refused to accept the constitutional complaint for decision. The petitioner had filed the constitutional complaint within the statutory one-month deadline but failed to submit the underlying lower court judgment and the petition as required, subsequently attempting to remedy this deficiency only after the deadline had expired. The Court held that the petitioner was at fault for this omission and denied reinstatement under § 93(1) of the Federal Constitutional Court Act, ruling that a diligent applicant must proactively obtain expert legal advice, consult specialized literature, or request the Court's informational booklet to correctly identify the formal admissibility requirements of a constitutional complaint; mere reliance on an erroneous belief that missing documents could be submitted late does not constitute an unintentional hindrance.

Nichtannahmebeschluss mit Tenorbegründung: Keine Wiedereinsetzung in die Monatsfrist des § 93 Abs 1 BVerfGG bei Verkennung der Zulässigkeitsanforderungen einer Verfassungsbeschwerde
[TENOR]
BVerfGK 2, 119 ).
Die Verfassungsbeschwerde wird nicht zur Entscheidung angenommen.
Diese Entscheidung ist unanfechtbar.
