Constitutional complaint inadmissible due to missed filing deadline and erroneous interpretation of procedural time limit start date
Legislator-Zusammenfassung
KI-generiertThe Federal Constitutional Court issued a non-acceptance order, rejecting the applicant's motion for reinstatement to the previous status, the request for the appointment of a legal guardian ad litem, and the constitutional complaint itself, thereby leaving the initial procedural deficiency unremedied and the complaint inadmissible. The dispute concerned a constitutional complaint that was filed after the one-month deadline under § 93(1) BVerfGG had expired, where the applicant claimed that the time limit began only upon formal service of the decision and a legal remedy notice. The Court held that the applicant failed to demonstrate that the delay was without fault, ruling that a legally erroneous interpretation of the start date of the procedural deadline does not constitute a valid ground for reinstatement, as such misinterpretation constitutes personal fault.

Nichtannahmebeschluss mit Tenorbegründung: Verfassungsbeschwerde wegen Versäumung der Monatsfrist des § 93 Abs 1 S 1 BVerfGG unzulässig - Ablehnung der Wiedereinsetzung in den vorigen Stand - Verschulden der Fristversäumung bei Verkennung des Fristbeginns
[TENOR]
