Constitutional challenge to involuntary medical treatment fails for failure to exhaust administrative remedies under the Family Court Code
Legislator-Zusammenfassung
KI-generiertThe Federal Constitutional Court refused to accept the constitutional complaint, ruling it inadmissible and thus leaving the lower court's authorization of compulsory treatment in force; the complaint challenged the district court's approval of a medical involuntary measure for a person subject to institutional care under German civil law. The Court held that the petitioner failed to exhaust legal remedies by not first filing a statutory objection under § 58 Abs. 1 and § 64 Abs. 1 Sentence 1 FamFG against the district court's decision, thereby violating the admissibility requirement of § 90 Abs. 2 BVerfGG.
