Constitutional complaint inadmissible for lacking express reference to specific proceedings in power of attorney under § 22 Abs. 2 BVerfGG
Legislator-Zusammenfassung
KI-generiertThe German Federal Constitutional Court did not accept the constitutional complaint for decision, leaving the challenged lower court ruling in force. The dispute arose from a procedural deficiency where the complainant’s legal representative failed to submit a valid special power of attorney following judicial notification, despite the underlying legal issue concerning the application of provisions in the Prison Act regarding the temporary suspension of burdensome measures. The decision rests on § 22 Abs. 2 Satz 2 BVerfGG, which mandates that a power of attorney must expressly reference the specific proceedings, rendering the general authorization for "constitutional complaint matters" insufficient to cure the admissibility defect.

Nichtannahmebeschluss: Mangels Vorlage einer Spezialvollmacht iSd § 22 Abs 2 S 2 BVerfGG unzulässige Verfassungsbeschwerde
[GRUENDE]
