Prison scheduling of inmate access times: exhaustion of legal remedies requiring hearing complaint
Legislator-Zusammenfassung
KI-generiertThe Federal Constitutional Court declined to accept the constitutional complaint for a decision, rendering the remedy inadmissible. The dispute concerned prison discipline, specifically a challenge to the shortening of "lights out" times for non-working inmates in a criminal prison. The Court held that the mandatory legal avenue was not exhausted because the complainant failed to file a hearing complaint (Anhörungsrüge) against the lower regional court's order, which had applied the incorrect statutory provision for provisional legal protection. The decisive legal basis for the dismissal is § 90 Abs. 2 Satz 1 BVerfGG (exhaustion of legal remedies), which requires the use of all statutory procedural remedies, including the hearing complaint where the higher court failed to properly hear the parties.
