Cost assessment in prison law proceedings: equitable determination under § 121 StVollzG when application becomes moot rather than withdrawn
Legislator-Zusammenfassung
KI-generiertThe Federal Constitutional Court declined to hear the constitutional complaint, leaving the underlying decision of the Enforcement Chamber in force. The dispute concerned a prisoner's challenge to a cost determination in a prison law remedy proceeding (pursuant to § 121 StVollzG), where the lower court interpreted a procedural statement regarding a mini-disc player as a withdrawal of the application rather than as the matter becoming moot because the prison had granted the request. The Court noted that while the lower court's interpretation of the procedural statement was barely understandable and failed to apply the principle of equity for cost assessment under § 121 para. 2 sentence 2 StVollzG, the complaint still lacked the prospect of success required for acceptance under § 93a para. 2 BVerfGG.
