Single fee claim under § 7(1) RVG when one representative acts for multiple clients in the same constitutional proceeding based on a jointly fixed matter value
Legislator-Zusammenfassung
KI-generiertThe Federal Constitutional Court dismissed the immediate complaint, upholding the legal officer's cost assessment where the represented parties' total legal fees were calculated based on a jointly fixed matter value of €4,000. The dispute concerned the interpretation of attorney's fees in constitutional proceedings, specifically whether a procedural representative acting for multiple complainants in the same case could claim separate fees for each client. Applying § 7(1) RVG, the Court held that when the requests of multiple clients are asserted uniformly within the same proceedings and share an internal connection, the representative is deemed to have acted in the same matter, entitling them to charge the fee only once based on the aggregate matter value fixed by the Court.

Zurückweisung einer sofortigen Beschwerde gegen Kostenfestsetzung: Tätigwerden des Bevollmächtigten in derselben Sache iSd § 7 Abs 1 RVG
[GRUENDE]
