Refundability of constitutional court abuse fee under GKG § 21: inapplicability of court fee refund rules to BVerfGG § 34 abuse fees
Legislator-Zusammenfassung
KI-generiertThe Federal Constitutional Court (1st Senate, 3rd Chamber) ruled that the complainant's application was inadmissible, thereby upholding the 2,500 DM abuse fee previously imposed for filing an abusive complaint under § 34 Abs. 4 BVerfGG (1985 version) and denying the requested refund. The dispute concerned the refundability of a constitutional court abuse fee under the German Court Fees Act (GKG); specifically, the complainant argued that the fee should be refunded under § 21 Abs. 1 Satz 1 GKG due to alleged incorrect procedural handling by the court. The Court held that § 21 GKG is inapplicable because the GKG does not extend to Federal Constitutional Court proceedings, which are generally free of charge under § 34 Abs. 1 BVerfGG; the abuse fee is not a statutory fee triggered by a procedural act but rather a substantive decision based on a non-appealable court order, distinguishing it from the fees governed by the GKG refund provisions.

BVerfGE 13, 289 ).
Diese Entscheidung ist unanfechtbar.
