Interim injunction denied for civil disobedience blockade; balancing of assembly rights against third-party interests
Legislator-Zusammenfassung
KI-generiertThe Federal Constitutional Court of Germany rejected the application for a temporary injunction, thereby upholding the administrative prohibitions and leaving the applicants without relief. The dispute concerned a challenge to a city order banning the occupation of public squares in the city center for blockade purposes, as well as restrictions on establishing information stands and holding demonstrations at a specific bank headquarters, all associated with a large-scale civil disobedience action. The Court held that under the doctrine of balancing consequences applicable to interim measures, the potential disadvantages to the applicants did not outweigh the threatened rights of third parties to such a degree that a constitutional injunction was urgently necessary, and thus declined to intervene.
