The Federal Constitutional Court issued a non-acceptance decision, rejecting the constitutional complaint as inadmissible and denying the applicant's request for readmission to the previous status. The dispute concerned the procedural admissibility of a complaint exceeding 500 pages that was faxed to the Court only four hours before the statutory deadline, a delay the applicant argued justified relief despite the substantial volume. The Court held that the complaint was barred by the one-month filing limit under § 93 Abs. 1 Sentence 1 BVerfGG and failed to meet the acceptance criteria of § 93a Abs. 2 BVerfGG, ruling that the late transmission was the applicant's fault; specifically, given the exceptional length of the document and the predictable congestion of fax lines in the evening, the applicant either should have initiated the transmission significantly earlier or at least prioritized the substantive pages, and thus could not demonstrate sufficient grounds for restoring the previous procedural status.
