Legislator-Zusammenfassung

The Federal Constitutional Court denied the applicant's request for legal aid to file a constitutional complaint, resulting in the rejection of the application and leaving the underlying decisions of the Landessozialgericht and Sozialgericht in force. The dispute concerned the applicant's attempt to challenge social court rulings via constitutional review, but the court found the intended complaint lacked sufficient prospects of success because it could not be filed within the statutory deadline under § 93 Abs. 1 BVerfGG, and no application for reinstatement of the deadline under § 93 Abs. 2 BVerfGG was submitted. Consequently, the court declined to provide further reasoning pursuant to § 93d Abs. 1 Satz 3 BVerfGG, rendering the decision final and unappealable.

§ 93 Abs. 1 BVerfGG

Cited as the procedural basis for the lack of prospects of success because the intended constitutional complaint could not be filed within the statutory deadline.

§ 93 Abs. 2 BVerfGG

Cited to note that no application for reinstatement into the former state was submitted, which precluded the timely filing of the complaint.

§ 93d Abs. 1 Satz 3 BVerfGG

Applied in the dispositive to dispense with a further detailed reasoning for the decision.
