Constitutionality of the five-percent threshold for Bundestag list seat allocation under the Federal Election Act
Legislator-Zusammenfassung
KI-generiertThe German Federal Constitutional Court dismissed a constitutional election complaint as manifestly unsuccessful, with the complainant prevailing in no respect. The dispute concerned the validity of the five-percent threshold for second-vote results required for a party to be considered in the allocation of Bundestag seats to state lists under § 6(6) Sentence 1 Alternative 1 of the Federal Election Act. The Court reaffirmed that this quorum is constitutional and provided no further detailed reasoning pursuant to § 24 Sentence 2 of the Federal Constitutional Court Act, noting that the complainant failed to respond to prior concerns raised by the reporting judge.

Verwerfung einer Wahlprüfungsbeschwerde (A-limine-Abweisung): Zur Verfassungsmäßigkeit der Fünf-Prozent-Sperrklausel (Quorum der Zweitstimmen für die Berücksichtigung einer Partei bei der Verteilung der Bundestagsliste auf die Landeslisten) gem § 6 Abs 6 S 1 Alt 1 BWahlG
[GRUENDE]
auf die Landeslisten berücksichtigt zu werden, als verfassungskonform erachtet (vgl. BVerfGE 1, 208 ;
