Legislator-Zusammenfassung

The Federal Constitutional Court rejected the constitutional complaint, ruling that the applicant did not prevail and the challenged decisions stand. The dispute concerned a civil case where the applicant alleged that the Federal Court of Justice violated her right to a lawful judge by failing to refer a question on the interpretation of the Brussels I Regulation to the Court of Justice of the European Union, and separately claimed a violation of her right to be heard regarding the rejection of her admission of appeal. The Court held that the lower court’s refusal to make a preliminary reference was constitutionally sustainable based on its assessment that the correct interpretation was evident from EU case law and teleological interpretation, and that the complaint failed to coherently demonstrate a substantive breach of the right to be heard as the applicant did not identify any ignored submissions regarding the origin of the funds in question.

Nichtannahmebeschluss: Keine Verletzung von Art 101 Abs 1 S 2 GG durch Unterlassen einer Vorlage an den EuGH bei vertretbarer Handhabung der Vorlagepflicht - Verletzung des Anspruchs auf rechtliches Gehör (Art 103 Abs 1 GG) nicht schlüssig dargelegt

[GRUENDE]
