Commencement of limitation period for trustee's release claim; no indications of fundamental rights violation
Legislator-Zusammenfassung
KI-generiertThe Federal Constitutional Court declined to accept the constitutional complaint, finding it lacked a prospect of success and did not meet the requirements for admission under § 93a Abs. 2 BVerfGG, thereby leaving the challenged lower court decisions in force. The dispute concerned the commencement of the regular limitation period for a trustee's claim for release (Befreiungsanspruch), where the complainant argued that the judicial decisions violated her fundamental rights. The Court determined that there were no indications of a fundamental rights violation based on the pleadings and exercised its discretion under § 93d Abs. 1 Satz 3 BVerfGG to forgo further reasoning, noting the decision is final and unappealable.
