Legislator-Zusammenfassung

KI-generiert

The German Federal Constitutional Court granted legal aid and appointed counsel to the complainant while rejecting the remainder of the application and refusing to admit the constitutional complaint for a merits review, as the necessary preconditions for admission no longer existed. The dispute concerned the respondent's challenge to a lower social court’s dismissal of a request for interim relief and the subsequent rejection of the complaint against that dismissal, within the context of social law proceedings. The court applied § 93d Abs. 1 Satz 3 of the German Federal Constitutional Court Act (BVerfGG) to dispense with a further reasoned explanation, citing the disappearance of the grounds for acceptance, while separately ruling on the ancillary procedural matter of granting process cost aid without installment payments.
