Age-based reduction of agricultural disability pensions before 63: compatibility of access-factor cuts with property and equality guarantees
Legislator-Zusammenfassung
KI-generiertThe Federal Constitutional Court declined to accept the constitutional complaint for decision, ruling it unfounded and upholding the statutory reduction of disability pensions for farmers claiming benefits before age 63, thereby allowing the state to prevail on the constitutional challenge. The dispute concerned a plaintiff challenging the constitutionality of § 23 Abs. 8 Satz 1 Nr. 1 of the Act on the Agricultural Pension Scheme (ALG), which implemented a pension reduction factor for early receipt of disability benefits following a 2000 reform law, alleging violations of property rights and equal protection under the German Basic Law. The court held that the provision was compatible with the constitution, relying on its parallel decision regarding the corresponding provision in the Social Code Book VI (§ 77 Abs. 2 Satz 1 Nr. 3 SGB VI), which had previously established that such age-based reductions of disability pensions for those under 63 do not violate Article 14 or Article 3 of the Basic Law.

[GRUENDE]
(vgl. BVerfG, Beschluss des Ersten Senats vom 11. Januar 2011 - 1 BvR 3588/08 u. a. -, juris).
