Legislator-Zusammenfassung

The Federal Constitutional Court of Germany deemed the proceedings moot and dismissed the applicant’s request for reimbursement of litigation expenses, while setting the value of the subject matter for the main constitutional complaint at €200,000 and the interim proceedings at €20,000. The case involved a combined institutional dispute and constitutional complaint challenging the ratification law for the 2004 Treaty establishing a Constitution for Europe, rendered obsolete by the replacement of that treaty with the Treaty of Lisbon in 2007. The decisive legal basis for the disposition was the obsolescence of the contested act due to subsequent supranational legislative changes, which extinguished the need for substantive review, alongside specific provisions of the German Constitution and the Lawyers' Remuneration Act governing the adjudication of costs and the valuation of the subject matter in constitutional litigation.
