Constitutional complaint inadmissible due to failure to prove attorney’s power of attorney under § 22 Abs. 2 BVerfGG
Legislator-Zusammenfassung
KI-generiertThe Federal Constitutional Court declined to accept the constitutional complaint for decision, ruling that the petition was inadmissible and no prior merits decision remains in force. The dispute involved a procedural challenge where the representative of the complainants failed to effectively lodge the complaint by not demonstrating valid authorization despite a specific request from the Court. The decisive legal basis was § 22 Abs. 2 of the Federal Constitutional Court Act (BVerfGG), which requires proof of mandate for representation, combined with § 93a Abs. 2 BVerfGG for the non-acceptance criteria, rendering the complaint inadmissible without further substantive review under § 93d Abs. 1 Satz 3 BVerfGG.
