Legislator-Zusammenfassung

KI-generiert

The Federal Constitutional Court declined to take up the constitutional complaint, rendering it inadmissible, and imposed a €200 abuse fee on the complainant for filing a manifestly hopeless legal remedy. The dispute arose from the complainant's challenge to the validity of the Federal President election held in May 2009, seeking its annulment on the grounds that it violated fundamental rights and specific constitutional provisions. The court held that the complaint lacked standing because constitutional complaints serve only to protect individual fundamental rights or equivalent rights under Article 93(1) No. 4a of the Basic Law, not to oversee the legality of state organization; the cited provisions, including the right of resistance and specific articles concerning democratic principles and the President’s election, did not confer individual complaint standing. The abuse fee was imposed pursuant to § 34(2) of the Federal Constitutional Court Act because the complainant persisted in filing an inadmissible complaint despite prior warnings from the Court’s President’s Council regarding its obvious futility.
