Time-barred constitutional complaint against tax court's interpretation of non-admission complaint: fault-based denial of reinstatement and failure to assert personal injury
Legislator-Zusammenfassung
KI-generiertThe Federal Constitutional Court dismissed the constitutional complaint as inadmissible, leaving the Federal Fiscal Court's decision of November 25, 2008, in force. The dispute concerned a tax procedure where the appellants challenged the Federal Fiscal Court's interpretation of their non-admission complaint, arguing it had incorrectly limited the remand to the tax court to only one appellant. The court held the complaint was time-barred and the request for reinstatement to the previous status was denied because the appellants were at fault for missing the one-month filing deadline; the legal basis centered on § 93 Abs. 1 and 2 BVerfGG regarding the complaint period and reinstatement without fault, combined with the requirement that a constitutional complaint must assert a specific personal injury, which the appellants failed to do by not raising a hearing objection (§ 133a FGO) against the lower court's interpretation while the remedy was available.
