Constitutional admissibility of challenging federal health insurance subsidies: individual rights do not prohibit specific use of public tax revenues.
Legislator-Zusammenfassung
KI-generiertThe Federal Constitutional Court dismissed the constitutional complaint as inadmissible, thereby upholding the challenged statutory provision and denying the petitioner relief. The case involved a privately health-insured individual who challenged the federal subsidy rate for statutory health insurance, as amended by the Statutory Health Insurance Competition Strengthening Act, arguing that the specific allocation of public funds violated his fundamental rights. The Court held that the petitioner lacked standing because he was not directly, personally, and presently affected by the legislation, which regulates the level of state financing for the statutory system. Relying on established doctrine, the Court ruled that an individual citizen cannot derive a general claim from fundamental rights, specifically citing Article 3(1) in conjunction with Article 6(1) of the Basic Law, to demand the cessation or annulment of a specific use of public revenues obtained through general taxation.
