Inadmissibility of constitutional complaint for failure to meet strict filing deadline for signature quora challenges
Legislator-Zusammenfassung
KI-generiertThe Federal Constitutional Court dismissed an organ claim by a political party as inadmissible due to the failure to meet the statutory filing deadline, thereby rendering the application for interim relief moot. The dispute concerned the signature requirements for candidate lists for the 2025 Federal Assembly election, specifically challenging the quorum rules applicable to party nominations. The Court based its decision on the procedural requirement of § 64(3) of the Federal Constitutional Court Act, which mandates strict adherence to filing deadlines for organ claims, and relied on its prior decision of December 10, 2024 (Case 2 BvQ 73/24), finding that the applicant’s arguments did not justify a different assessment or an extension of the time limit.
