Legislator-Zusammenfassung

KI-generiert

The Federal Constitutional Court rejected the applicant's request for the reimbursement of necessary expenses in a constitutional complaint proceeding, as no special equity reasons justifying the application of § 34a(3) of the Federal Constitutional Court Act were established. The dispute involved an application for cost recovery following the non-acceptance of a constitutional complaint, where the applicant argued that a prior decision was "legally excluded," an assertion the court found incomprehensible and insufficient to meet the high threshold for discretionary reimbursement. The decisive legal basis is § 34a(3) BVerfGG, which grants reimbursement only when the constitutional complaint remains unsuccessful and special equity reasons are explicitly presented or evident, a condition not met in this instance.

Ablehnung der Auslagenerstattung nach Nichtannahme der Verfassungsbeschwerde

[TENOR]
