The Federal Social Court (BSG) dismissed the plaintiff's complaint against the non-admission of revision as inadmissible, thereby upholding the Landessozialgericht Baden-Württemberg's judgment of February 21, 2017. The dispute concerned a social law matter where the plaintiff attempted to challenge the lower court's refusal to allow an appeal to the BSG by submitting two simple e-mails on March 31 and April 10, 2017, which were deemed by the court to constitute a complaint against non-admission. The decision turned on strict procedural requirements: the plaintiff failed to comply with the statutory mandate that a non-admission complaint must be filed within one month of the judgment's service through an attorney admitted to practice before the BSG, and additionally violated the requirement that electronic filings must contain a qualified electronic signature to be legally valid; consequently, the court rejected the complaint without substantive review under § 160a Abs. 4 and § 169 SGG.

Sozialgerichtliches Verfahren - keine rechtswirksame Rechtsmitteleinlegung durch einfache E-Mail

[TENOR]
