The Federal Social Court dismissed the plaintiff's complaint for lack of admissibility and denied his application for legal aid, ruling in favor of the opposing party. The dispute concerned an appeal against the Social Court of Berlin-Brandenburg's decision not to grant leave for revision. The court held that the complaint was inadmissible because the mandatory justification was not filed within the statutory deadline, rejecting the argument that the representative had implicitly reserved the justification until a decision on legal aid was made. The denial of legal aid was based on the lack of sufficient prospects of success for the intended legal action. The decisive legal bases were § 160a (2), (4) SGG regarding the strict compliance with the justification deadline for non-admissibility complaints, and §§ 73a SGG in conjunction with §§ 114, 121 ZPO for the denial of legal aid and the assignment of a lawyer.

Sozialgerichtliches Verfahren - Nichtzulassungsbeschwerde - Zulässigkeit - Versäumung der Begründungsfrist

[TENOR]
