Jurisdictional determination for joint claim by co-heirs claiming domestic nursing care costs against health insurance
Legislator-Zusammenfassung
KI-generiertThe Federal Social Court determined that the Social Court of Würzburg was the competent court for the pending proceedings, an order that is final and unchallengeable. The dispute involved co-heirs of a deceased mother who jointly sued a statutory health insurance provider for reimbursement of costs for domestic nursing care, but filed their joint claim at a single court despite residing in different judicial districts, prompting the lower court to request a ruling on jurisdiction. The Federal Social Court affirmed that because the co-heirs constituted necessary co-litigants, a single common venue was required to ensure consistency, and it designated the chosen court (where one plaintiff resided and where the case had been pending since 2006) as the exclusive forum under § 58(2) SGG and § 74 SGG in conjunction with § 62(1) ZPO, as no shared local jurisdiction existed under § 58(1) No. 5 SGG.
