Classification of a contract for the supply and installation of sunshade control systems as a construction contract under § 650a BGB
Legislator-Zusammenfassung
KI-generiertThe BGH 7th Civil Senate dismissed the defendant's complaint against the non-admission of revision, thereby upholding the Berlin Kammergericht's appellate judgment and leaving the first-instance outcome intact, with the defendant ordered to bear the costs of the appellate proceedings. The dispute concerned the legal classification of a contract for the supply, installation, and programming of a sunshade control system, specifically whether it constituted a construction contract under German law. The court determined that while the appellate court erred in reasoning that the sunshade control itself constituted a building or structure, this error was immaterial because the contractual obligation to supply, mount, and program the system inherently involved the creation of a part of a building within the meaning of § 650a(1) sentence 1 BGB, thereby establishing the contract as a construction contract regardless of the specific definition of the equipment.

Halbsatz ZPO).
Die Beklagte trägt die Kosten des Beschwerdeverfahrens (§ 97 Abs. 1 ZPO).
