Legislator-Zusammenfassung

KI-generiert

The German Federal Court of Justice rejected the plaintiff's non-allowance of appeal complaint, leaving the appellate court’s decision denying admission of the legal appeal in force and ordering the plaintiff to bear the costs. The dispute concerned a tort claim for damages allegedly caused by the defendant's measures, with the plaintiff arguing that the appellate court had failed to refer preliminary questions to the Court of Justice of the European Union regarding the interpretation of the EU Short Selling Regulation and the applicability of financial services law. The Court held that these questions were not decisive to the outcome because the appellate court had independently and correctly determined that the causal link between the defendant's actions and the plaintiff's claimed damages was absent, thereby rendering the contested legal issues moot.
