The German Federal Court of Civil Justice (BGH) dismissed the plaintiff’s complaint against the non-admission of an appeal to the court of revision, thereby upholding the Oberlandesgericht Koblenz’s decision and leaving the plaintiff to bear the costs of the proceedings. The dispute concerned a civil claim alleging that the defendant, a public authority, violated its duties under Regulation (EU) No. 236/2012 (Short Selling Regulation) and general administrative law through specific enforcement measures. The BGH held that the case lacked fundamental legal significance or a need to develop the law because the complaint failed to demonstrate that the EU law questions identified by the plaintiff were decisively relevant to the outcome; instead, the court applied an ex-ante perspective to assess whether the authority’s actions were professionally and legally justifiable, considering the urgency of the threat and the scope of its duty to investigate. Consequently, even if the plaintiff’s interpretation of the EU regulations were correct ex post, the measures remained defensible under the required ex-ante standard, precluding fault on the part of the authority.

Volltext
