Adequacy of tender notice under EU non-discrimination and transparency principles in admission procedures
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice dismissed the plaintiff's non-acceptance complaint, thereby upholding the lower court's decision to deny the appeal to the Revisionsgericht and leaving the earlier ruling in force; the plaintiff bore the costs of the proceedings, which were valued at €500,000. The dispute concerned the interpretation of EU fundamental principles, specifically whether the principles of non-discrimination, equal treatment, and transparency required a specific type of public notice to inform interested economic operators about the essential characteristics of an admission procedure. The court held that no preliminary reference to the Court of Justice of the European Union under Article 267 TFEU was necessary, as the required transparency standard was already established by existing EU case law, which mandates that notices enable operators to gain adequate knowledge of the procedure's progress and features, leaving it to national courts to assess compliance with these requirements.
