Admissibility of EncroChat data and rejection of analogous stay motions in organized criminal proceedings
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Justice (BGH) 4th Criminal Senate dismissed the appeals of multiple defendants as unfounded against the judgment of the Bremen Regional Court of 16 July 2024, leaving the conviction and sentence intact and ordering each appellant to bear the costs of their respective appeal. The defendants challenged their convictions in a criminal case, and one defendant additionally filed alternative motions to stay proceedings, which the court rejected. The decision confirms the validity of the original verdict as no legal errors to the defendants' detriment were found. The court further noted that, given the settled legal position of the BGH, the European Court of Justice, and the Federal Constitutional Court regarding the admissibility of data from a specific encrypted communication provider (EncroChat) and the principle of expeditious proceedings, the requested stay of proceedings was not granted.
