Lawyer disciplinary proceedings: Inadmissibility of appeal due to missing electronic filing form under § 116 BRAO
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) dismissed the complaint of a lawyer against the non-admission of the revision, leaving the judgment of the Lower Saxony Lawyers' Court in force and ordering the lawyer to bear the costs of the legal remedy. The dispute concerned the procedural admissibility of the lawyer's appeal and subsequent complaint in a disciplinary proceeding, where the lower court had refused to admit the revision. The decisive legal basis was the unfulfilled requirement under § 145 Abs. 3 Satz 3 BRAO to explicitly identify a fundamental legal question or violation of the right to be heard; additionally, the BGH noted that the prior appeal was itself inadmissible because the lawyer failed to submit the legal remedy in the mandatory electronic form prescribed by § 116 Abs. 1 Satz 2 BRAO in conjunction with § 32d Satz 2 and § 32a StPO.

Schmitt in Schmitt/Köhler, StPO, 68. BGH, Beschluss vom 25. Juni 2025 - AnwSt (B) 2/25, juris Rn. 2; Weyland/Reelsen, BRAO, 11. Aufl., § 37 Rn. 5, § 143 Rn. 4, § 146 Rn. 1, 6; Dittmann/Thole in Henssler/Prütting, BRAO, 6. Aufl., § 116 Rn. 16).
Der Kostenausspruch folgt aus § 116 Abs. 1 Satz 2 BRAO, § 473 Abs. 1 Satz 1 StPO.
