Denial of substitute jurisdiction under § 13a StPO where objective jurisdiction for seizure proceedings is established at the location of secured funds
Legislator-Zusammenfassung
KI-generiertThe BGH 2nd Criminal Senate dismissed the request by the Prosecution Office of Schwerin to designate the Local/District Court of Schwerin as the competent court under § 13a StPO, ruling that no lack of a competent jurisdiction existed. The dispute concerned the objective criminal proceedings for the seizure of a financial asset, specifically a secured bank account balance, where the prosecution argued that a specific court should be assigned for the handling of the seizure. The court held that the request was inadmissible because the objective proceedings under § 436 (1) sentence 2 StPO already established the competence of the Local/District Court of Berlin, where the bank holding the secured funds is located. The decisive legal basis was the interpretation of § 436 (1) sentence 2 StPO, which links jurisdiction to the physical location of the seizure object, even when that object consists of obligatory or property rights rather than tangible goods, as defined in § 435 (2) sentence 1 StPO.

Ablehnung einer Gerichtsstandsbestimmung
[TENOR]
