Legislator-Zusammenfassung

The Federal Court of Justice (4th Civil Senate) dismissed the debtor's challenge as inadmissible, leaving the lower court's cost assessment order in force. The dispute concerned a procedural attempt by the debtor to challenge the Federal Court of Justice's order of 24 October 2025, which had previously addressed a recollection (Erinnerung) against the initial cost assessment in the insolvency proceedings. The court ruled that no legal remedy lies against a decision of the Federal Court of Justice regarding a recollection against the cost assessment; specifically, an appeal under § 66(3) sentence 3 GKG is not available, and a further appeal under § 66(4) sentence 1 GKG is inadmissible. The court further determined that recharacterizing the challenge as a representation (Gegenvorstellung) was unsuccessful because the debtor's arguments pertained to the substantive correctness of the underlying decision rather than a violation of cost law.

Volltext
