Objection to BGH court fees for inadmissible legal appeal; 2.0 fee on €500 dispute value upheld under GKG
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) rejected the plaintiff's objection to a court costs assessment, thereby upholding the requirement for the plaintiff to pay €76 in court fees. The dispute arose after the BGH dismissed the plaintiff's legal appeal as inadmissible and fixed the amount in dispute for the appeal procedure at a maximum of €500; the plaintiff subsequently challenged the resulting €76 fee invoice, arguing against the assessment's appropriateness. Applying the German Court Costs Act (GKG), specifically § 1(5), § 66(6), and § 22(1) in conjunction with the cost table in Annex 2, the court determined that a 2.0 fee base for an amount in dispute of up to €500 correctly equated to €76, confirming the assessment was legally compliant and not subject to reduction.
