Adhesion proceeding: Scope of general acknowledgment and requirement of specific application for survivor's benefit
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Criminal Procedure dismissed the defendant’s appeal as unsubstantiated but vacated the lower court’s ruling on the adhesion claimants’ entitlement to survivor’s benefit, with the defendant ordered to bear the costs of the appeal and necessary expenses of the auxiliary and adhesion claimants. In a criminal appeal against a Landgericht Mönchengladbach verdict, the only legal error identified was that the trial court had rendered a decision on survivor’s benefit in the adhesion proceeding without any corresponding application filed by the adhesion claimants. The court held that under Section 308 (1) of the Code of Civil Procedure, a court cannot award relief that has not been requested; consequently, the defendant’s general acknowledgment of “adhesion claims” did not encompass the specific survivor’s benefit, which was never joined to the proceedings, and the ruling on this point was reversed under Section 406 (1) Sentence 3 of the Code of Criminal Procedure.
