Untimely complaint for lack of leave to appeal and denial of legal aid due to lack of prospects of success and failure to meet the dispute value threshold
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) dismissed the plaintiffs' complaint for lack of leave to appeal as inadmissible, rejected their application for appointment of a statutory lawyer, and denied legal aid, leaving the Stuttgart Higher Regional Court's prior decision in force. The dispute concerned a civil matter where the plaintiffs challenged the lower court's denial of leave to appeal a ruling involving a disputed value of 9,000 EUR. The decisive legal basis for the dismissal was the plaintiffs' failure to substantiate the complaint within the extended deadline pursuant to § 544(4) Sentence 1 German Code of Civil Procedure (ZPO); additionally, the court found the intended legal enforcement hopeless as the case did not involve questions of fundamental importance, and the likely dispute value remained below the 20,000 EUR threshold required by § 544(2) No. 1 ZPO, rendering the appeal without prospect of success under § 543(2) ZPO and legal aid inappropriate under § 114(1) ZPO.

4. Die Kostenentscheidung folgt aus § 97 Abs. 1 ZPO.
