Admissibility of appeal challenging defense by legal trainee under § 139 StPO due to failure to submit power of attorney
Legislator-Zusammenfassung
KI-generiertThe Bundesgerichtshof (BGH) dismissed the defendant’s appeal as inadmissible, upholding the Landgericht München I judgment of February 10, 2025, and ordered the defendant to bear the costs of the proceedings. The dispute centered on a criminal appeal challenging the composition of the defense team during the first day of main proceedings, where a legal trainee (Rechtsreferendar) with one year and ten months of service acted as an auxiliary representative for the chosen defense attorney. The court determined the challenge was inadmissible under § 349 Abs. 2 and § 344 Abs. 2 Satz 2 StPO because the defendant failed to submit the power of attorney authorizing the appointment of an auxiliary representative, which was necessary to establish that the representation complied with § 139 StPO, a provision permitting such arrangements in elected defense cases (unlike mandatory defense). Additionally, the court rejected the argument that the trial court failed to provide a mandatory "constitutionally compliant" instruction regarding this specific defense configuration, noting that the defendant’s prior express consent to the auxiliary representation rendered the alleged lack of instruction immaterial.
