Adhörungsrüge against denial of legal aid for legal complaint in enforcement proceedings
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) dismissed the debtor's motion for a hearing (Anhörungsrüge) regarding its prior ruling, thereby affirming the denial of legal aid and leaving the earlier decision to reject the debtor's application for legal aid for a legal complaint in force. The dispute concerned a procedural request for legal aid to pursue a legal complaint against an intermediate appellate court's decision, where the debtor argued that the higher court violated its right to be heard when it denied the aid on the grounds that the intended litigation lacked reasonable prospects of success. The court held that the lower panel had properly considered the debtor's submissions and detailed its reasoning for finding no merit in the appeal, and that the debtor failed to demonstrate a credible violation of the right to be heard under Article 103(1) of the German Basic Law, citing § 321a ZPO for the hearing motion and § 114(1) ZPO for the legal aid requirement.

Volltext
Die Anhörungsrüge des Schuldners vom 8. August 2025 gegen den Beschluss des Senats vom 9. Juli 2025 wird zurückgewiesen.
[GRUENDE]
