Applicability of Distance Contract Exception to Construction and Mixed-Contract Agreements
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Justice (BGH) dismissed the defendant's non-acceptance complaint, thereby upholding the Stuttgart Higher Regional Court's judgment and leaving the defendant to bear the costs of the proceedings. The dispute concerned whether the exception provision in § 312g(2) No. 4 BGB, which exempts certain contracts from distance contract regulations, applies to construction contracts and mixed-type contracts involving works agreements. The court held that the defendant's challenge based on a lack of Union law clarification was unfounded, as the interpretation of the relevant EU law was so evident that no reasonable doubt existed to justify a preliminary reference to the Court of Justice of the European Union under Article 267(3) TFEU.

Halbsatz ZPO).
Der Beklagte trägt die Kosten des Beschwerdeverfahrens (§ 97 Abs. 1 ZPO).
