Legislator-Zusammenfassung

KI-generiert

The Federal Court of Justice (5th Criminal Senate) dismissed the defendant's appeal as largely unfounded, upholding the lower court's conviction for drug trafficking offenses, while ordering a clarifying amendment to the sentence as an aggregate custodial sentence and excluding the confiscation of 25,000 EUR from the total forfeiture order. The dispute centered on a conviction by the Regional Court of Leipzig for three counts of trafficking narcotics in non-quantity, one of which involved cannabis, and eleven counts of cannabis trafficking, alongside an initial order to confiscate 1,088,350 EUR in proceeds; the defendant challenged the judgment on grounds of violating substantive law. The decisive legal basis included § 421 Abs. 1 Nr. 3 StPO for the discretionary exclusion of partial confiscation, § 349 Abs. 2 StPO for dismissing the revision as unfounded, and § 473 Abs. 1 and 4 StPO, which imposed the full costs of the appeal on the defendant despite the minor procedural success.

[GRUENDE]
