Permissibility of waiver judgment in non-admission complaint proceedings following patent invalidation
Legislator-Zusammenfassung
KI-generiertThe BGH 10th Civil Senate dismissed the claim, granting the defendant the relief sought via a decree of waiver, with costs borne by the plaintiff. The dispute concerned an action for infringement of a European patent, where the defendant had filed a non-admission complaint against the lower court's denial of leave to appeal. After the patent in question was declared null and void in separate proceedings, the plaintiff formally waived its claims under § 306 ZPO, prompting the defendant to request a waiver judgment. The court issued the decree without an oral hearing, relying on the established doctrine that a waiver is permissible even during non-admission complaint proceedings, as per §§ 555(1) and 306 ZPO.
