Legal aid for jurisdiction determination proceedings denied due to absence of negative competence conflict
Legislator-Zusammenfassung
KI-generiertThe BGH 10th Civil Senate dismissed the application for legal aid to initiate a jurisdiction determination proceeding, finding no sufficient prospect of success. The dispute concerned the appropriateness of a legal aid application following the Landgericht Berlin II's rejection of an appeal against a lower court's denial of legal aid for a claim seeking the removal of a compulsory security mortgage. The Federal Court of Justice held that the prerequisites for a court jurisdiction determination under Section 36 ZPO were not met, specifically noting the absence of evidence in the files for a negative conflict of jurisdiction (competence conflict) under Section 36(1) No. 6 ZPO, as the prior rejections were not based on a lack of jurisdiction.

September 2024 (96a T 1/24).
