Inadmissibility of legal complaint lacking attorney representation and denial of legal aid for lack of prospects of success
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) rejected the legal complaint, dismissing it as inadmissible and ordering the appellant to bear the costs, leaving the Munich Regional Court’s February 2025 decision in force. The dispute involved a challenge to the appellate court’s denial of legal aid and subsequent appointment of counsel for a party who had applied for procedural assistance in a civil matter; the appellant, an individual, filed the legal complaint without representation by a lawyer admitted to the BGH. The decisive legal basis was the requirement that legal complaints before the BGH must be filed by an admitted attorney, coupled with the BGH’s prior rejection of the underlying legal aid application for lack of reasonable prospects of success; the court further held that the subsequent termination of a guardianship proceeding by the local court did not alter the admissibility assessment, which was governed by the status of the case at the time of the appellate decision, with costs allocated under § 97 Abs. 1 ZPO.
